| 摘 要： | 我国现行法律没有对检察机关是否享有民事诉讼违法调查权作出明确规定,但检察机关事实上却在行使着该权力,检察机关行使该权力的规范依据见于现行司法解释。民事诉讼违法调查权的行使范围是民事诉讼违法行为。民事诉讼违法调查权行使方式多样,但应当严格禁止使用限制被调查人人身自由或者财产权利的强制性调查措施。民事诉讼违法调查权行使程序包括启动、进行和终结三个方面。

| Abstract: | The ivestigation right of civil illegal proceedings is not provided explicitly in our current civil procedural law,but which is provided in the current judicial interpretation,and procuratoratal organs exercise the power actually.The scope of the ivestigation right of civil illegal proceedings is civil illegal proceedings proceeds.The patterns of exercising the ivestigation right of civil illegal proceedings is various,but limiting the personal feedom and property right of the persons being investigated in coercive investigation methods should be forbidden.The procedure of exercising the ivestigation right of civil illegal proceedings includes beginning,conducting and concluding. |
