| 摘 要： | 诉讼上抵销的性质研究,在我国大陆一直没有得到较多的重视,特别是在从诉讼上抵销性质的角度,来探讨民法上抵销的形成权性质和民法上抵销制度行使方式方面,更显得不足。文章正是从诉讼上抵销的实体法和程序法二重性的关系上,探讨了诉讼上抵销的民法意义。

| Abstract: | While the study on the essence of set-off in legal procedure has not been given enough noticein Chinese mainland, this paper, from the view of the essence of set-off in legal procedure, discusses thecharacteristic of shaping--right (Gestaltungsrecht) of set--off in civil law and the executive method of set-offin civil law. This paper has explored the civil meanings of set--off in legal procedure with the display of thedual nature of the set--off in legal procedure: of the entity law and of the procedure law. |
