论行政行为的代表性

"行政行为"是行政法学的重要范畴,但其代表性质的研究却一直被忽视。虽然民法学界论及了董事、经理等人员的代表行为,但行政法学在这相通的方面则完全是空白。行政法学应予以借鉴,在阐述行政行为的代表属性时,引入代表行为概念,在此基础上推进行政表见代表制度的确立,由此更加明确行政机关工作人员公务行为的不同种类、性质、后果,区别对待,以促进依法行政。

On the Representative Behavior of Administrative Law

Administrative behavior is the important category in administrative law,but the study on it's representa- tion has been neglected yet.Though the administrative behaviors of director and manager have been discussed in civil law,the similar aspect of administrative law is still marginal.So the administrative law should elaborate the representa- tive attributes of administrative behavior,import the concept of representative behavior and promote the establishment of apparent representation so as to define different categories,nature,consequence of official behavior of administrative personnel,and then differentiate all of them and spur the administration by law.
