| 摘 要： | 要建成中国特色的社会主义法治国家,首先应从理论与实践的层面上解决好社会性的号召与个体的道德响应之间的关系,笔者称其为形成法律人的"首唱"与非法律人的"唱和"的法治的共识效应.为此,本文通过对"共识效应"进行理论论证与实证分析后,试图从精英文化与大众文化对立统一的视角,对全球化背景下的当代中国法治建设,提出具有中庸思想特色的若干己见.
