| 摘 要： | 绑架罪是刑法分则规定的重要个罪,社会危害性极大,也是司法实践中的多发犯罪。在绑架罪的构成、认定及处罚等诸多方面,历来存在多种观点的聚讼,其中许多争点至今仍未有定论。鉴于绑架罪司法适用的重要性和法条设计的特殊性,有必要对这一罪名进行全面、系统的探讨。

| Abstract: | The crime of kidnapping is a very important crime in the Specific Provisions of the Criminal Law , which has severe social damage, and happens regularly in the judicial practice. The legal theory and judicial practice always have many different kinds of viewpoints in the constitution of crime, even in the cognizance and punishment of the kidnapping crime, many points of contention still have not had the conclusion until now. Because its importance and particularity , it is necessary to carry on systemic and comprehensive research. |
