| 摘 要： | 司法监督制度的改革与完善是一个庞大而复杂的理论问题,从司法判断力这一角度进行探讨,分析司法判断力监督的整体理念,提出应强化当事人的诉讼权利,由"权力对权力"的监督转向"权利对权力"的监督;强化上诉程序的监督功能,弱化程序外部的环境压力等制度设计建议。
