| 摘 要： | 精神损害赔偿一直是我国民法学中的一个疑难问题 ,其赔偿范围、数额的确定亦是我国民法学研究的重点问题 ,但我国现行法律关于精神损害赔偿的范围、精神损害强度的划分和精神损害赔偿额的计算标准等方面仍存在一定的缺陷 ,因此应扩大我国民法中关于精神损害赔偿的范围 ,明确划分精神损害强度 ,并以精神损害持续时间和损害造成的病理表现为基础计算精神损害赔偿额。

| Abstract: | How to pay for the hurt of spirit is a difficult problem of civil law,with its limits and its amount being the key question in research.What is the bound of the pay,how to carve up the intensity of this hurt,and how to culculate the amount of the payment are still not perfect.Based on those three questions,the writer advances modification of the limit permitted by civil laws,based on the lasting of the hurt and the behaviour,and gives us a set of the payment for the hurt of spirit. |
