| 摘 要： | 在法治原则下 ,救济与权利是相附随的 ,任何权利在受到侵犯时都必须有救济。教育权利的实现也需要救济机制。教育权利救济是教育权利实现的程序化机制 ,教育权利救济机制的框架是以宪法救济为根本 ,诉讼救济为主导 ,诉讼外救济为补充的整体。

| Abstract: | In a society ruled by law, relief follows rights. All the rights should possess relief when offended. So does the educational right. This article points out that educational right relief is the procedural mechanism in the realization of the educational right. The framework of the educational right relief is on the basis of constitution, guided by the litigation relief, supplemented by the relief except litigation. |
