| 摘 要： | 本文从制度结构、受益人范围、资金筹措和经办机制四个方面对德、法两国的工伤社会保险法律制度进行了比较,分析了两国制度在结构、内容等方面的差异及其优劣,指出了中国工伤社会保险法律制度的缺陷,并提出应在借鉴德、法两国制度的基础上对中国的制度安排从五个方面进行完善。

| Abstract: | From the angles of the structure of institution, the scope of beneficiary, the raising of fund and the mechanism of handling, this text compares social insurance legalities on the employment injury of Germany and France , analyses the differences and reasons of their structures and contents, points the defects in the social insurance legalities on employment injury of China, and advances to perfect Chinese system from five aspects after drawing lessons from the systems of Germany and France. |
