土地征收侵权救济方式比较研究

我国的土地征收侵权救济方式为行政裁决,国家赔偿和传统的民事赔偿的组合救济,其具体的责任形式较为单一,不利于广大征收相对人土地权益的保护。考察英美法系代表国英美、大陆法系代表国德法以及日本相关立法可知,采取民事、行政和刑事混合的救济手段是世界土地征收侵权救济方式总的发展趋势。我国应从开拓传统民法保护,深化民事救济机制;完善行政救济相关机制,将土地征收侵权纠纷的行政处理方式作为前置程序、强化刑事救济机制的最后屏障作用,加重对相关责任人的惩罚力度等方面来完善我国土地征收的法律制度。
