| 摘 要： | 结合最高法院新近发布的司法解释中对行政附带民事诉讼所作的有关规定，对建立行政附带民事诉讼制度的理论依据与现实意义，行政附带民事诉讼成立的条件、范围和种类等相关问题，从理论上和审判实践上进行了较为深入全面的具体分析与论述，建议尽快对行政诉讼法进行修订，补充完善，以确立我国行政附带民事诉讼制度。

| Abstract: | It is a new topic that administrative lawsuit accompanied by civil lawsuit since Law of Administrative Lawsuit was put into practice. This law, for many years, hasn't given a definite answer to administrative lawsuit accompanied by civil lawsuit, which has stirred lots of discussions. This paper, based upon recent judicial explanations given by the Supreme People's Court, uses some cases to analyze the theoretical base, application, possibility as well as trial efficiency of administrative lawsuit accompanied by civil lawsuit. In addition, this paper offers some tips to the revision of the Law. |
