法规审查对诉讼程序的若干影响

法规审查是我国立法法及法规规章备案条例中规定的对立法实施监督的机制之一,其存在有合理的必然性。然而在法院审理案件过程中,对法律与法规之间、法规与法规之间的冲突问题,法院仅有选择适用权而无解释的权力,也没有司法审查权力,因此,在案件审理过程中,对启动法规审查、实施审查均需规定相应的措施加以完善,以保证审查活动和诉讼活动的正常进行。

The Impact of Regulation Review to Litigation Procedure

Regulation review is one of necessary supervisory system to legislation,but facing confliction between laws and regulations,confliction of regulations each other in the case,the judge only has right to choose suitable laws but has no right to interpret it,or no right to have judicial review to legislation.So how to put forward regulation review,and how to handle reflection of litigation procedure in regulation review,need to be completed.
