困境与展望：对日民间索赔途径之思考

中国对日民间索赔运动始终坚持了一条诉讼的道路，但如今，无论是在日本国内还是在其境外进行的诉讼都陷入了不同形式的困境。其中在日本的诉讼遭遇了日本最高法院败诉判例的重大障碍．在美国的诉讼由于政治因素的介入显得前路未卜，而在中国进行的诉讼则由于有限豁免主义的“双刃剑”效应而显得十分棘手。开辟诉讼以外的索赔途径已是一个亟待解决的问题，而由国家代表受害者进行国际求偿，以及敦促日本国内进行赔偿立法，则是两种具有可行性的非诉讼索赔途径。战争损害赔偿问题的全面解决也正有待于诉讼与非诉讼索赔途径的协力运作。

Dilemma and Prospects: the Methods of Claim for Civil Compensation against Japan

In China＇s claim for civil compensation against Japan, the normal method is litigation. But for many reasons, this method is now on the horns of dilemma, no matter the litigation is in Japan or in other countries. For example, the judgment of litigation by Japan Supreme Court in China it is very tough because of limited modes. The first one is international claim indulgence. passed against China; in America the results are uncertain; is time to discuss the non-litigation method. There are two made by the state on behalf of the victims; the second one is compensation legislation in Japan; both are feasible.
