| Abstract: | The "overbearing clause" violates the value in freedom, equality and equity of market economy. The clause is ubiquitous in real lives and it encroaches on consumers' rights. The unfair judgement of overbearing clause can be carried on by way of economic analysis. And we analyse its reason in order to provide strategic basis for eradicating overbearing clause. |
