论政府微观监管职能独立化

监管型政府理论及法律不完备性理论确立了分析独立监管组织生成机理的分析框架,但都没能解释独立监管机构承担微观监管职能的必要性。以科学技术的快速发展为根本动因,政府微观监管职能逐渐从政府宏观调控职能中独立出来,从而构成了独立监管的行政基础。这对于我们思考如何完善我国独立监管组织具有重要实践意义。

On the Independency of Microcosmic Regulatory Function

Both the theory of regulatory state and theory of incomplete law construct the framework of independent regulatory commission,however,neither of them can answer the question why the traditional government is not appropriate to assume the regulatory function.With the development of science and technology,microcosmic regulatory function becomes independent,which is the basis of administrative law of the independent regulatory organization.This is important to consummate our independent regulatory organization.
