| 摘 要： | 民事法律责任与国家赔偿责任是不同分类标准下产生的法律概念,两者之间并非"水火不容"。结合相关法理,以现行法制状况为基础,从解释论的视角对不动产登记机关登记错误损害赔偿责任的性质进行分析,不动产登记机关登记错误赔偿责任的性质应界定为民事法律责任。而从赔偿责任承担的角度分析,其又是国家赔偿责任。

| Abstract: | Although civil liability and state compensation liability are two different legal concepts which result in a different classification criteria,they are not incompatible.With relevant jurisprudence and on the base of current legal conations,the nature of the liability for compensation of the wrong real estate registration should be defined as civil liability in an analytic study.But it is also the state compensation liability from the point of view to bear liability. |
