前期物业管理若干问题研究

摘    要:《物业管理条例》中使用了前期物业管理这一新概念,并对其作了一些规定。对于这一新的制度,尚有很多问题值得探讨:前期物业管理企业是否有资格与建设单位进行承接验收?前期物业管理的时间界限如何确定?业主大会成立前,建设单位能否向主管部门申请在物业管理区域内修建新的建筑物?若主管部门予以批准,是否意味行政侵权?本文认为,可以赋予前期物业企业承接验收的资格,但对其法律效果应予以完善。前期物业管理的开始,以物业上的权属性质属于区分所有权为前提。前期物业管理于业主委员会与物业管理企业签订的物业服务合同生效时终止。对于建设单位的申请,只要建设单位不是唯一的业主,且申请未获得全体业主同意,主管部门的批准将构成行政侵权。

Abstract:Early stage property managementa new term,is used in Property Management Regulations.A lot of new issues about this term should be discussed-is the early stage property management enterprise qualified to check the building? How to determine the time limit of early stage property management,etc.It is pointed out in this paper that the early stage property management enterprise can be qualified to check the building.However the legal effect should be perfected.When the contact goes into effect signed by owner committee and property management enterprise,the early stage property management comes to an end.If the authority ratifies the application which is not agreed by all the owners,made by the building unit which is not the only owner,the action constitutes infringement of the lawful right.
