从法律实证、现实功能和理论基础角度入手,通过对强制性缔约制度、格式合同制度、附随义务制度的分析,对合同自由原则进行重新审视,认为必须用发展的观点来看待合同自由原则,对合同自由原则的限制并非是对此原则的根本否定,而是作为一种修正,以恢复其本来的价值和地位,从而使这一原则更具有社会适应性和现实需要性。

Restriction on free principle of the contract in modern market economy

From the legal real diagnosis,the realistic function and theoretical foundation angle,and through analysis of the mandatory system,format contract system,attendant obligations system,the principles of freedom of contract is re-examined.The authors believe that it is necessary to hold development perspective the principle of freedom of contract,and the contemporary principles of freedom of contract should not be restricted to the fundamental principles of the negative,but as an amendment to restore its original value and status, so that this principle is more socially adaptable and practical.
