论中国经济法与儒家文化的耦合——关于经济法民族性的另一条探索路径

中国经济法的产生与发展经受着中国历史文化的洗礼,体现出＂中国化＂的特殊规律。中国儒家文化源远流长,其基本精神体现为＂仁、义、群、和、中＂,映射出中华民族文化的基调,并为中国经济法的产生与发展提供了丰富的文化土壤。具体而言,儒家文化为中国经济法的产生与发展提供了所需的人文资源、伦理基础、立身之本、理念支撑及方法路径。同时,中国经济法亦在与儒家文化的互动相融中成长进步,两者在诸多方面存在耦合。鉴于经济法研究的本土性和文化的延续性,我们还得出经济法的移植应当慎行和我国应当创建具有东方文化背景经济法等两点启示。

The Integration of Chinese Economic Law with Confucian Culture——Another Path to Highlight the National Character of Economic Law

The emergence and development of Chinese economic law embody the special rules with ＂Chinese characteristics＂ due to the influences from the Chinese historical culture.Chinese Confucian culture enjoys a long history.Its essential ideologies of ＂benevolence,righteousness,group,harmony and moderation＂,reflecting the basic cultural flavor of the Chinese nation,have provided a rich cultural soil for the emergence and development of Chinese economic law,which is specifically embodied in the spheres of human resources,ethic bases,foundation of growth,ideology,and approach.Meanwhile,Chinese economic law has been developing along with the Confucian culture and the two have been integrated in many aspects in the course of interactions.Considering the aboriginality of economic law research and the continuance of culture,it is suggested that the transplantation of economic law be carefully conducted and the economic law with eastern cultural background be initiated in China.
