| 摘 要： | 我国目前地方保护主义对统一市场的分割和垄断相当严重,宪法以其法律权威性及规范性应当成为统一国内市场最有力的制度保证,借鉴美国联邦宪法对州际贸易壁垒的成功规制,以宪法条文明示禁止分割市场的行为,必须强化宪法的相关功能,这有利于我国回应"入世"挑战,促使宪政框架下的市场经济体制的真正确立。

| Abstract: | The domestic market has been seriously divided due to local protectionism .Constitutional laws ,with the highest authority and regularity , should provide the most effective guarantee in removing local barriers from free trade and unifying the domestic market .Edified by the Commerce Clause in the Constitution of the United States of America which succeeds in eliminating the barriers to the free flow of interstate commerce ,our Constitution should forbid in explicit terms any kind of blockade to free trade .A constitutional provision means a lot in meeting the future challenges after China's WTO accession and promoting the establishment of the market economic system within the framework of constitutional government. |
