关于法学高等教育理论基础的思考

进入21世纪后,特别是加入WTO后,中国加快了法制建设的步伐,社会对法律人才的质量提出了更高的要求。人们开始探讨高等法律教育应该如何发展,但其热点一直是关注教育方法、教学内容、教学模式等。文章则思考另一个层面的问题,即中国高等法律教育的理论基础,作者认为由于中国断断续续的法学教育历史和中国特殊国情,到目前中国高等法律教育没有稳定的法学教育理论基础和完善的法律教育体系。并提出高等教育当务之急是结合中国的国情加强基础理论研究工作、构建中国高等法学教育理论基础和教育体系。

Thought about basic theory of high law education

After entering the 21 century,China has accelerated her pace of law construction.The society asks for more qualified persons who are good at law.People start to talk about how to develop high education of law.But they only focus on the method ,the content and the model of law education all the time.Whereas,this article talks about another question,which is the basic theory of China's high education of law,In the author's opinion,because of the uncontinual history of law and China's special situation,so far,China's high education of law hasn't had a stable basic theory or a compulsory task of law education.That is,according to China's situation ,we should strengthen thinking about the basic theory and the construction of a basic theory and system of law education.
