我国低碳生物技术发展的法律激励机制探索

低碳生物技术应用于能源与环境等领域将能缓解能源需求,改善生态环境,实现经济与社会的可持续发展。我国低碳生物技术的法律激励机制应体现在统筹规划与约束性目标、研发投入支持、财政与税收优惠、收购激励与政府采购以及培育和完善市场等方面。低碳生物技术发展不仅需要一整套规范的、系统的激励机制,而且还应落实到现实运作中,实现其高效性和有效性的统一。由此,需要政府在战略规划与计划、法律法规及其配套、产业管理与市场监管、经济与财税优惠等方面完善体制,也需要企业和市场理性发展,形成从制度设计到技术产业化的良性运行。

Exploration of the Legal Incentive Mechanism for the Development of China＇s Low-carbon Biotechnology

The application of low-carbon biotechnology in fields such as energy and environmental protection will help us ease the energy demand, improve the environment, and achieve a sustainable economic and social development. Our legal incentive mechanism for the development of low-carbon biotechnology should be reflected in the following aspects： overall planning and＇ binding targets, increased capital support to research and development, favorable fiscal and tax policies, encouraged acquisition and government procurement, as well as cuhivation of a sound market. The development of low-carbon biotechnology requires not only a well designed incentive mechanism, but also the operation of this mechanism in actual situations, where the efficiency and efficacy of it can be realized. Therefore, the government should endeavor not only to improve and perfect such systems as related to formulation of strategic planning and programs, implementation of relative laws and supporting regula tions, adoption of favorable economic policies or preferential fiscal and tax schemes, but also to maintain the rational development of business and market, thus achieving a sound running condition from the design of mechanism to the industrialization of technology.
