我国《海商法》是否应该取消航海过失免责的研究

摘    要:有关我国《海商法》是否应该取消航海过失免责问题 ,我国各界的观点并不统一 ,本文对取消航海过失免责对船方和货方的利益平衡、法律制度的可操作性、国际的统一性和前瞻性以及我国整体利益的影响等方面进行了论述 ,认为在目前条件下 ,我国的《海商法》应该保留航海过失免责 ,但从长远看 ,我国《海商法》应当取消航海过失免责

Abstract:The views of whether the nautical fault exemption should be eliminated in CMC or not was not unified yet in China. In this paper, based on discussing the influence of the elimination of the nautical fault exemption on the beneficial balance between carrier and merchant, the maneuverability,international unification and developing trend of the legal system, and the collective interests of China, it was proposed that the nautical fault exemption should be preserved at present but should be eliminated in the future.
