| 摘 要： | 基于历史的原因中国农村土地流转不充分，这严重限制了农民利益的有效实现，在某种程度上也限制了市场经济规律在农村的实现。现行立法中对农村土地承包经营权流转形式规定不足。应当取消转让土地承包经营权需经发包方同意的限制，允许承包方抵押农村土地承包经营权及农村土地承包经营权以入股等方式以扩大流转。

| Abstract: | In view of problem that there is not enough transaction of the land contracted management right,the flaw of law about transaction of land contracted management right is analyzed,proposing that we should cancel the restriction that the transaction of land contracted management right must be agreed by the collective organization,also suggesting mortgage and share may become two kinds of transaction of land contracted management right. |
