“刑罚反制”初论

在罪刑关系上,学界长期以来强调罪对于刑的制约作用,而忽视了刑对于罪的决定作用。刑罚对犯罪的成立也具有决定性的作用,这就是刑罚反制。刑罚反制的根据在于刑罚具有相对于犯罪的独立性、刑罚与犯罪具有相互依存性、刑罚与犯罪之间的联系具有复杂性以及刑罚目的对手段具有制约性。刑罚反制不仅体现在刑法观念中,而且体现在刑事立法与刑事司法中。
