This paper focuses on the problem of the prior claim of the construction project, describing it in the following three aspects first, the nature of the prior claim of the constraction project is a legal mortgage right, different from the lien. Second, the prior claim of the construction projects is prior to the mortgage right of the construction, and when it comes into conflict with Customer right, preferential protection should be given to the latter. Last, the request right of the construction project's advanced pay should be excluded from it.
