立法科学的界定及其运作形式

文章从立法科学的范畴界定出发,考察哪些法律活动或法律现象应当纳入立法科学的研究范畴,逻辑地引入立法科学的功能分析,并认为立法科学的功能是对其价值精神的引申和体现,包括引导功能、整合功能、补正功能、督促功能等诸方面。最后得出结论,立法科学运作的直接目的就在于建立科学合理的规则,而这些规则具有终极价值的作用。这些终极性价值至少应当包括正义、权利(利益)、自由和秩序。

Legislation Science Limitation and Its Operation Form

This paper discusses which law activies and law phenomena should be included into the range of legislation science and logically introduced the functional analysis of legislation science,from the limitation of the range of legislation science.And the author considers that the function of the legislation science is the performance of its value.The functions include guiding function,integrating function,repairing function,supervising function and so on.Finally the paper leads to the conclusion that the aim of the operation of legislation science is building the reasonable rules which have the function of ultimate value.These ultimate values at least should include justice,profit,freedom and order.
