先秦农家思想研究的法律视域初探

先秦农家作为形成于春秋战国时期的一个重要思想流派,其思想中有很多政治思想应作为政治法律研究的一部分。尤其是农家思想中包含着古代朴素的治国思想,因而更不能将其从法律视域中剔除。先秦农家法思想可以分为许行的治国思想与《吕氏春秋》中的农家政治思想两个思想派别。许行的思想主张大致有＂君民并耕＂的治国理想和＂市贾不贰＂的经济＂法＂思想。吕氏农家的法思想体现为：＂农教为本＂的宏观治国理念;通过影响中国传统法制中的具体法律制度,农业技术思想内化为传统法制中的农家法元素,实现对传统法制的影响。

A Preliminary Research into the Farmer Thinking Studies in Pre-Qin Dynasty in the Perspective of Law

Being an important school of thought,the farmer was formed in Spring and Autumn Period,and many of their political thoughts should be regarded as the contents of political and legal researches.Especially the ancient plain thoughts of ruling the country are included in the farmer thoughts,and can not be removed from the visual field of law.The farmer thinking in Pre-Qin Dynasty could be divided into two schools namely Xu Xing＇s thoughts of ruling the country and the farmers＇ political thoughts in ＂Lu＇s Spring and Autumn Annals＂.
