劳资矛盾预警机制中的政府职能研究

摘    要:政府在劳资矛盾预警机制中具有“发现”和“预防”群体性劳资纠纷突发事件的职能.本文提出“预警机制+群体性事件应急处理”的二重结构,旨在协调政府在劳资争议中兼具的“调停者”与“执法者”双重角色.然后,讨论了预警程序的监控对象、启动指标及标准.最后,分析了强制调查权的侵权风险,提出确保企业调解委员会的主体合法性、为行政机关设定“保密义务”等规避措施.

Abstract:The functions of the administrative power in the contradiction early warning mechanism between labor and capital include the discovering and guarding against the group emergency between labor and capital.The paper tries to tell the construction of the Contradict Alert Mechanism;the launch norms and the standards.Finally the paper tells the risk of the right infringement of the compelling inquiry power,and gives some suggestions.
