| 摘 要： | 外国在刑事诉讼中普遍确立的婚姻关系特权规则,体现了对其他社会价值和利益的维护,体现了对夫妻之间这种特殊信赖关系的保障及对人格尊严与人权的关注。我国具有在刑事诉讼中设立婚姻关系特权的必要性与可行性。但应注意明确婚姻关系特权中配偶的范围,规定告知程序以及婚姻关系特权的例外。 |

| Abstract: | The privilege of marriage relation is established commonly in foreign criminal procedure.This em-bodies the guarantee of the peculiar relation and the attention to dignity of human personality and human rights.Criminal procedure in our country has necessity and feasibility to establish the privilege of marriage relation,but should pay attention to the range of spouse,and provide informing procedure and the exception of marriagerelation. |
