论危险犯犯罪中止的时间性条件

危险犯的犯罪中止是指在直接故意犯罪过程中,行为人自动停止其犯罪行为,或者自动有效地防止危害结果发生的一种危险犯的犯罪形态,其时间条件是“在犯罪过程中”。对于“犯罪过程”有广义和狭义的理解,对于危险犯而言,其中止形态分为三种类型,即:预备阶段的犯罪中止;实行阶段的犯罪中止;完成实行行为、法定危险状态尚未发生阶段的犯罪中止。不同类型的危险犯犯罪中止的时空范围不同,即时间性条件不同,应区别对待。必须区分两个界限:即犯罪中止与犯罪未遂的界限,犯罪中止与犯罪既遂的界限,从而准确地把握危险犯犯罪中止的时间性条件,正确地定罪量刑,充分发挥刑罚预防犯罪的社会作用。

The crime discontinuance in potential damage offence refers that an actor stops criminal behavior automatically or prevent harmful consequence effectively and automatically in the course of direct intention crime. It's timeliness condition is "in the course of crime ".About " crime course", there are different understandings both broad sense and narrow sense. As to the potential damage offence, it's discontinuance statehas: preparation discontinuance, commission discontinuance and discontinuance after process of commission but before dangerous state happens. Different kinds of discontinuance of crime have different timeliness condition, should treat them with a certain discrimination. We must distinguish two demarcation lines: discontinuance of crime and inchoate crime; discontinuance of crime and completion of crime, so as to hold timeliness condition, convict crime and weigh sentence accurately and exert the social function on penalty that prevent the crime sufficiently.
