| 摘 要： | 不管"宪政是民主政治"的观点,还是"宪政是宪法的具体实施状态"的观点,或"宪政是对权力的制约、监督、制衡及对人权保护"的观点,都无法得出"宪政是什么"的满意答案;而传统的三种综合回答"宪政是什么"的范式,也陷入了"宪政客观属性回答法"。鉴于此,以马克思、迪尔凯姆和韦伯的理论为依据,通过价值的范式,对"宪政是什么"进行了分析和回答。

| Abstract: | Constitutionalism can not obtain a satisfied answer whether it is democratic politics or a real state of constitution or restriction,supervision,control and human right protection of rights.However,three traditional comprehensive answers to what constitutionalism is are restricted to objective answers to constitutionalism.As a result,according to the theories of Marx,Emile Durkheim and Max Weber,under a value outlook,this paper analyzes and answers what constitutionalism is. |
