| 摘 要： | 《医疗事故处理条例》的发布实施在解决医患纠纷,缓解医患冲突方面确实起到了一定的积极作用,然而仍然应当清醒得看到《条例》中存在的问题以及可能对医疗纠纷诉讼产生的影响。笔者试图对医疗纠纷民事诉讼中适用《医疗事故处理条例》的几个问题作简单的探讨。

| Abstract: | The Code of Medical Treatment Accidents does play a positive role in dealing with the disputes between patients and doctors and alleviating the conflicts between them. However, we should keep sober to notice the existing problems in the code and their potential influence on the civil lawsuit of medical treatment. The author attempts to discuss some problems applicable to the code in the lawsuit of medical treatment dispute. |
