| 摘 要： | 网络游戏产业的迅速发展，使网络虚拟货币大量发行和使用，这给用户利益和国家金融秩序带来一定的风险。通过分析网络虚拟货币的法律性质、功能以及存在的潜在风险，认为应对网络虚拟货币进行适度的监管，即通过立法或司法解释明确网络虚拟货币的法律性质，加强对网络虚拟货币发行和交易行为的监管，从而强化对网络虚拟货币持有人利益的保护。 |

| Abstract: | Virtual currency is a kind of electronic security certificate of claims to the issuer, with micro-payment functions and reward functions. With the popularity of the Internet and rapid development of online gaming industry, a large number of virtual currencies have been issued and used. The issuance and use of virtual currency bring a certain degree of risk to the users and the country＇ s financial order. It is suggested that it is necessary to clarify the legal nature of virtual currency through legislation of judicial interpretation, to strengthen the regulation of the issuance and transaction of virtual currency, and to protect the interests of the holders of virtual currency. |
