| 摘 要： | 当代各国证据制度的发展趋势是以自由心证主义为主 ,并进行了相应的改良。面对我国入世后与国际法律接轨的新形势 ,最高人民法院的新民事证据规定大胆地吸收和借鉴了国外自由心证制度的一系列原则和规则 ,初步确立了有中国特色的自由心证制度 ,但是还有待于从法官素质、监督机制等方面继续完善

| Abstract: | In the present society, the tendency of various country's evidence system is mainly the free evaluation of evidence, and do some reform as well. After entering WTO, China must follow suit with the international law. The new stipulation of civil evidence which formulated by the highest people's court learn bravely from other countries, and established the initial free evaluation of evidence system based on China's features. To perfect this system, we must do more work on judge's quality, supervision mechanism and so on. |
