探望权制度的法律适用探析

针对《婚姻法》探望权制度法律适用存在的问题,采用比较法学的研究方法,对中国探望权制度的主体、中止和强制执行等法律适用问题进行了评析,提出了如下立法建议：规定探望权主体行使探望权利的指导原则即子女最佳利益原则;扩大探望权的主体范围;明确探望权中止的情形;规定探望权执行的基本原则;增加探望权的救济措施。

Analysis of legal application of system of visitation right

In recent years,along with the rising of divorce rate,the disputes of visitation right have been gradually increasing.In this paper,in view of the problems existing in the legal application of the system of visitation right prescribed in Marriage Law of the People＇s Republic of China,the study method of comparative jurisprudence is adopted to analyze the legal application problems of the subject,suspension and enforcement of visitation right system in China,and the following legislation suggestions are proposed,i.e.,to prescribe the guiding principles of exercising visitation right by the subject of visitation right,also known as the principle of best interest for the child,to expand the subject scope of visitation right,to determine the situation of suspension of visitation right,to prescribe basic principles for implementation of visitation right and to increase remedy measures of visitation right.
