| 摘 要： | 从民愤的概念、渊源、古代作用入手，理性分析将民愤视为刑罚裁量参考依据之一的利与弊，主张在刑事司法在遵循罪刑法定原则、罪责刑相适用原则的前提下，对民愤进行客观、准确地分析和鉴别，以做到司法审判效果与社会影响的有机统一。

| Abstract: | From the concept, the origin, the ancient function of populace indignation, this article rationally analyses the merits, malpractices of populace indignation considering in Criminal justice, and advocates objectively, accurately analyses it in the prem- ise of the principle of Law - Determining - Crime punishment and Criminal punishment, Responsibility, Penalty adapting consistently, so as to combine organically the judicial trial effect and the social impact. |
