司法审查为何运行不畅,行政诉讼如何走出困境--从权力(权利)制约角度分析司法审查陷入困境的症结与对策

中国的司法审查制度在实践中运行不畅,其症结就在于司法审查所要求的权力分工与制约无法实现,权利与权利及权力与权力不对等、不平衡(即权力结构不均衡),没有市民社会里的社会权力制约国家权力.因此培育成熟的市民社会,健全党对司法审查工作领导的方式;完善利益分配机制,消除行政权对司法权的非正当控制,等等,则不能不是我们走出司法审查困境的可取对策.

Why Is Judicial Review not Well Conducted and How Can Administrative Legal Proceedings Get out of the Dilemma?

The Chinese judicial review system does not work well in practice. The main reason lies in the fact that the separation of power and division required by judicial review system is not carried out; there is disequilibrium between power and rights and a lack of check on the state power from citizens. Therefore, the countermeasures are to develop political awareness of mass citizens, to improve the way the Party guides the work of judicial review, and to do away with administration's non-justified control over judicial conduct.
