| 摘 要： | 当知识产权遭受到侵害时,不仅知识产权权利人的权益受到了损害,知识产权被许可人的权益也受到了损害。然而,在符合法律规定的诉讼中,被许可人的诉权性质如何,尚无定论,这是一个在理论上和实践中都非常重要的问题。尽管我国有关的法律对被许可人的诉权作出了一些规定,但是关于被许可人的诉权性质在理论和实践上仍有必要做进一步的探讨。在二元知识产权体系理论的框架下,上述问题将会得到很好的解决。
