| 摘 要： | 优先权制度是民法中一种具有独特作用的制度,其起源于罗马法,后来的法国民法、日本民法、瑞士民法等,都对优先权制度加以继承和发展。在我国构建民法体系的过程中优先权制度应当占有一席之地,并发挥其应有的积极作用。

| Abstract: | Priority is a right that is the characterics of techenical standard.Priority system is a special system among civil laws.It came from Roman civil laws.Later,French civil law,Japanese civil law,Swiss civil law,Italian civil law and Holland civil law inherited and developed it.Priority system should be built when we build Chinese civil law system and make it play an important role. |
