监委会移送的职务犯罪案件需经检察机关审查起诉

监察委员会整合反腐监察资源、集中履行对公权力的监督职能，是深化国家监察体制改革后产生的重要机构。全国人大常委会发布的《关于在北京市、山西省、浙江省开展国家监察体制改革试点工作的决定》规定“对涉嫌职务犯罪的，移送检察机关依法提起公诉”，那么监委会移送的案件是否需要审查起诉？文章认为，从立法程式、公诉职能实质化、人权保障、证据等因素考量，检察机关审查起诉能够有效保障检察监督职能，因此监委会移送的案件应当先审查后起诉。
