| 摘 要： | 伦理与法律是保护环境的两种主导方式。对生态环境保护来说，道德伦理建设与法制建设同等重要，后者是制度层面的，是强制性的，前者是内心自觉的，是基础性的。如果单纯依靠法律的外在强制力量并不一定带来人们心理上对保护环境的认同，而只有得到人们普遍心理认同，只有这两种外在与内在性因素的同构与融合，才能切实达到环境保护的目的。所以生态建设，要坚持依法治理和以德治理相结合。 |

| Abstract: | Ethics and law are two kinds of leading methods for environment protection. With regard to ecological environment protection, both morale ethics construction and laws construction are the same important, the latter is at institutional level and is coercive while the former is intrinsic and is basic. If only legal external enforcement can not make the people psychologically agreement, but only the psychologically common agreement of the people and only the homogeneity and integration of the two kinds of intrinsic and external factors can attain the goal of environment protection. Thus, ecological construction should stick to the combination of legal and morale management. |
