人权司法保障制度与侦查程序改革要论

党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》强调,＂国家尊重和保障人权＂,要＂完善人权司法保障制度＂。2012年刑事诉讼法规定的侦查程序在提高惩罚犯罪能力的同时,也提升了对犯罪嫌疑人、被告人的人文关怀水平,但侦查程序的结构性矛盾仍然未得到有效解决。完善侦查程序人权司法保障制度需要牢固树立正当程序理念、坚持人本主义和权利救济原则、遵循司法的规律和特征,合理控制侦查权,切实加强对犯罪嫌疑人、被告人基本人权的保护。

Analysis of the Protection of Human Rights in the Judicial System and the Reform of Investigation Procedure

The decision of CPC central committee on a number of major issues concerning the deepening of reform,passed at the Third Plenary Session of the Eighteenth National Congress of CPC,stresses the points about ＂ the state respects and safeguards human rights＂,and ＂ to improve the protection of human rights in the judicial system＂. The provisions about the investigation procedure prescribed in the criminal procedure law in 2012 not only improved the capacity of the punishment of crime,but also promoted the level of humanistic care for the suspect and the defendant,but the structural contradictions of the investigation procedure have not yet been solved. Therefore,to improve the protection system of human rights in the investigation procedure needs to firmly establish the concept of due process,adhere to humanistic principles and rights of relief,observe the judicial rules and features,get the investigation right under reasonable control,so as to strengthen the protection of the basic human rights of both the suspect and the defendant.
