| 摘 要： | 反思近代中国宪政历程,对比英美宪政经验,认为一种有效的宪政框架必须源于本土人民的经验,必须与经过改造了的本土传统相容,宪政在文化上应该是中立的,并为各种文化提供合法空间,从而实现正式规范与社会习俗相互支持,在此条件下才能构建稳定健全的宪政制度。

| Abstract: | The modern Chinese constitutional government process is inspected.Contrasting British and American constitutional government experiences,it is thought that a kind of valid constitutional government frame must come from the people's experience and be compatible with the reformed tradition.The constitutional government should be a neutral on the policy of cultures,and provide the legal space for various cultures.That the formal norm and social customs support mutually will help set up a stable and sound constitutional government system. |
