| 摘 要： | 美国宪法第一修正案集中体现着美国制宪者的精神,其文本的高度简明性为满足社会与科技的发展提供了所必需的灵活解释空间。对第一修正案的理论阐释主要存在三种方式,即传统主义、修正主义和渐进主义。不同的阐释方式代表了社会及政府对媒体管制的不同态度。这对我国的媒体管制及其改革提供了一种观察的视角。

| Abstract: | The First Amendment of U.S.Constitution intensely embodied the spirit of Founding Fathers.Its brief text provides a flexibility of law interpretation necessary for satisfying the requirements of social development and technical innovation.Generally,there are three approaches to interpret the First Amendment in theory,i.e.traditionalism,revisionism and gradualism.The different interpreting approaches represent different attitudes of the society and government towards media regulation.The analysis provides a significant prospect for Chinese media regulation and its reform. |
