| 摘 要： | 论述了知识产权对竞争促进和阻碍的双重作用,指出知识产权领域的反垄断是当代反垄断法的一个重要课题;以利益平衡论为视角审视两者之间的关系,并比较与借鉴了外国的立法经验,以期对我国这一领域的立法有所裨益。

| Abstract: | The paper looks at the dual role of intellectual property rights in promoting and obstructing competition.It holds that the struggle against monopoly in the field of intellectual property rights is an important issue in the contemporary anti-monopoly legislation.It further explores the relationship between the two from the perspective of interest balance.By comparing and borrowing relevant experience in legislation abroad we can improve our legislation in such a field. |
