摘    要:永佃制是我国明、清时期东南沿海地区比较普遍存在的一种土地租佃形式 ,是发展得较完备的物权性质的土地使用制度。永佃制下永佃权的出现使佃农获得稳定的使用土地的权利 ,佃农的利益有了较多保障 ,对封建经济的发展起到相当大的推动作用。当前 ,作为我国经济体制改革突破口的土地承包经营制度 ,突破了原有的“集体所有 ,共同经营”体制 ,调动了农民的生产积极性 ,对国民经济发展做出了重大贡献。但随着改革的进一步深入 ,土地承包经营权不稳定、债权性、难流转等局限日益明显。因此 ,我们在土地使用制度上借鉴永佃权稳定、易于流转的优点来改造土地承包经营权将是有益的和可行的。

Abstract:Permanent land lease, a popular form of land lease in the southeastern coastal regions of China in the Ming and Qing Dynasties, is a full fledged land use system with real property right quality. Under the PLL system, cottiers secured stable land use right and hence the guarantee of their interests, which pushed the development of feudal economy. On the other hand, in the land contract and management system a gap in the economical reform of our country the traditional "collective ownership and joint operation" is bleached and therefore the peasants production enthusiasm is aroused, which contributes to the development of national economy. However, as the deepening reform increasingly reveals the instability, creditor right and stranded circulation of LCM system, it is beneficial and feasible to draw upon the stable, circulatable PLL system.
