| 摘 要： | 低碳经济改变了环境管理理念和角色,促使企业从被动守法转向主动参与环境治理,节能减排自愿协议为此搭建良好平台。节能减排自愿协议从实践到规范、从政策到法律的升华必须明确其法律规制必要性、主体、内容、适用范围、法律定性等制度内核。广州开展节能减排自愿协议行动已初见成效,结合对节能减排自愿协议制度进行思考,有助于＂低碳广州＂目标的实现和相关制度的进一步规范化运作。

| Abstract: | Low-Carbon economy has changed the ideas as well as roles of environmental managements by promoting the role of enterprises from a passive abider to a positive participant.Volunteer agreements for energy conservation and pollutant-reduction（VAs hereafter）serve this change well.Uprising from a pure practice to a regulation,and from a policy to a legal code,VAs stipulate a clear definition of its regulation necessity,subject,contents,application range,and legal nature.Guangzhou,as a pioneer for practicing VAs in low-carbon economy,has witnessed the initial success.Therefore,the combination of the studies on VAs with Guangzhou＇s experience will be helpful to the realization of＂Low-Carbon Guangzhou＂and the further normalization of mechanisms. |
