| 摘 要： | 文章对历史上各民族"共同疆域"所涉及到的历史内容及其形成演变过程进行探讨,认为"共同疆域"指的是国内的不同民族之间或同一民族在不同国家所共同拥有的疆域."共同疆域"分历史上的共同疆域与现代的共同疆域两种类型."共同疆域"往往又和跨界民族联系到一起,牵涉复杂的疆域归属理论问题.文章围绕着"共同疆域"的形成及类型、"共同疆域"的衍生问题、"共同疆域"所涉问题之国际法解释等三方面,讨论"共同疆域"沿革过程中形成的国际惯例及其对当代处理国与国之间历史疆域遗留问题的借鉴意义.

| Abstract: | This article explores the historical content and evolution of joint territory of each ethnic group in history,believing that the "joint territory" refers to the cooperate boundaries owned by different ethnic groups and different countries in the world.Joint territory is divided into two categories: historical joint territory and modern joint territory."Joint territory" is often connected with trans-ethnic groups concerning the complicated theory of boundary ownership.This article focuses on three aspects of joint territory: its formation,its types as well as the development and explanation of its issues by international law.It also discusses the international convention formed in the process of joint territory evolution and the salutary lessons for dealing with the remaining problems on the historical territories of countries. |
