美国排污权交易对我国之启示

排污权交易制度作为治理环境污染的-一种切实可行的经济手段，以其在优化环境容量资源配置、减少污染物排放总量、提高环保执法效率等方面的优势，成为解决环境问题最科学、最有效的出路，在总量控制的制度之下刺激污染物排放量的削减，从而达到保护和改善环境质量之目的。美国的排污权交易政策自实施以来，在实践中获得了显著的生态效益和经济效益。引入美国立法的相关先进经验用以提升我国排污权交易制度的完善，可谓是求得“他山之石”。本文旨在通过梳理、分析美国排污权交易理论与实践，以期全面把握排污权交易制度，为我国建立和完善排污权交易制度探索出一些有益经验。

Enlightments of American Emission Rights Trading for China

The emission trading system as a viable economic instruments of controlling environmental pollution, with its optimizing the allocation of environmental capacity resources, reducing emissions and improving the efficiency of environmental protection law enforcement and other advantage, becomes the most scientific and effective way to solve environmental problems, under the total amount control of system stimulates reduction of pollutant emissions, so as to achieve the purpose of protecting and improving environmental quality. Since the implementation of the emission trading policy in the United States, obtained remarkable ecological and economic benefits in practice. Introducing the advanced experience of the legislation to promote perfect emission trading system of China, might be called the ＂golden stone＂. This paper aims to analysis the theory and practice of emission trading in American, in order to comprehensively grasp the emission trading system for establishing and improving the emission trading system to explore some useful experience in China.
